Who We Are
Modern Financial is a consumer intake and enrollment company. We are
not a law firm, a lender, a creditor, a credit repair organization, or
a debt settlement provider. We do not provide legal advice, tax advice,
credit repair services, or investment advice.
Solar Matters
Consumers who contact us about a solar loan, lease, or PPA are screened
for eligibility and, if appropriate, referred to an independent law
firm. That firm is solely responsible for evaluating whether to accept
representation, for all legal advice, and for the handling of any
matter it accepts. Modern Financial does not select legal strategy,
provide legal advice, or represent consumers. No attorney-client
relationship is formed with Modern Financial under any circumstances,
and no attorney-client relationship with the referred firm exists
unless and until that firm accepts representation in a signed written
agreement. The firm is not licensed in every state.
Debt Settlement
Consumers who contact us about unsecured debt are screened and, if
appropriate, enrolled with an independent debt settlement provider.
That provider is solely responsible for negotiating with creditors.
Modern Financial does not charge advance fees for debt relief services,
and the enrolled provider charges fees only after a debt has been
renegotiated, settled, reduced, or otherwise altered and the consumer
has made at least one payment under that arrangement, consistent with
the FTC Telemarketing Sales Rule, 16 C.F.R. § 310.4(a)(5).
Important Risks of Debt Settlement
– Enrolling will likely adversely affect your credit score.
– Creditors are not obligated to negotiate, and some will not.
– Creditors may continue collection activity, including calls, and may
file suit against you.
– Interest, late fees, and penalties generally continue to accrue on
unpaid accounts, and your balances may grow during the program.
– Forgiven debt may be treated as taxable income and reported to the
IRS on Form 1099-C. Consult a tax professional.
– Not all debts are eligible.
– Discontinuing payment to creditors is a decision only you can make.
How We Are Compensated
Modern Financial receives compensation from third-party providers for
referrals and enrollment services. This creates a financial interest in
your enrollment. You are never obligated to use any provider we refer
you to, and you may pursue any option independently, including
contacting your creditor directly, working with a nonprofit credit
counseling agency, consulting an attorney of your own choosing, or
taking no action.
